The Brian case triggered major discussions in Switzerland – the “Rundschau” 2020 also reported on him.
Brian Henry Keller, known under the pseudonym Carlos, was in solitary confinement for more than three years in the Pöschwies prison in Regensdorf ZH. At the beginning of this year, the prisoner was transferred to the district prison in the city of Zurich.
Now the Zurich High Court has announced that Brian must be released from prison. It justifies it by saying that preventive detention is strictly regulated by law; among other things, it must be proportionate and may not last longer than the imprisonment to be expected. In the case of Brian, a continuation of the preventive detention is no longer proportionate because the length of detention to date has come very close to the expected length of imprisonment, which is likely to be due for the offenses committed by the accused.
