In the canton of Zurich, a bad Google rating led to a court case. In December 2021, a woman (45) complained via Google about an alternative medical practice. The evaluation speaks of a bad mood and an unsuccessful treatment – the owner and therapist are described as snooty. Her voice is penetrating and she won her education in the lottery, they say. The author only gave it one star out of five.
It is now clear that the dissatisfied woman was never in the practice. As the “Zürcher Unterländer” reports, she was acquitted on Thursday before the Bülach ZH District Court.
Criticized for revenge
As the newspaper writes, it is reasonable to assume that the woman wanted to take revenge on the therapist. Because she now lives with her ex-husband.
Previously, she had already covered her successor with insulting messages on Whatsapp. She described them as “cheap”, “disgusting-wobbly” and “chubby-stupid”. The news resulted in a criminal warrant. But the defendant did not accept this and demanded a court assessment.
Review still online
After the court date it is clear: neither the insults via WhatsApp nor the bad rating on Google have any consequences.
The reason: “The criticism in the assessment does not affect her personally, but her professional activity and does not fall under the concept of honor in the criminal sense,” said the judge. This honor was not violated by the Whatsapp messages.
The bad Google rating therefore remains online – several requests to Google to remove it were unsuccessful. According to the judge, the only thing the plaintiff can do is try to have it deleted with the help of a magistrate. (bra)
