federal court
Opponents’ objection partially approved
The Federal Supreme Court has partially approved the appeal of three associations against the expansion of the quarry in Le Mormont VD. It recognizes the value of the «La Birette» site and requests that the landscape be restored once the quarrying is complete.
The operating license for the quarry cannot be issued in the form approved by the Canton of Vaud. This is what Helvetia Nostra, Pro Natura Vaud and the Association for the Protection of Mormont (Association pour la sauvegarde du Mormont) write in a press release distributed on Thursday.
The 2020 judgment of the Cantonal Court of Vaud is overturned. The Environment Department must take into account the recommendations made by the Federal Commission for Nature and Cultural Heritage (ENHK).
The federal court held that the great wealth of the hill should not be ignored. However, there is also a public interest in cement production. It is therefore necessary to clarify the modalities of the replenishment once the dismantling is complete and to guarantee the recovery.
