Prosecutors are now investigating the Alpstaeg ad
The public prosecutor’s office in Lucerne is examining the complaint against Bernhard Alpstaeg. How that turns out is completely open. Three scenarios are possible.

Now it’s time to get down to business. The Lucerne public prosecutor’s office confirms to Blick that the criminal complaint filed by the FCL leadership against Bernhard Alpstaeg is being investigated. A partial success for minority shareholder Josef Bieri and Co. Ultimately, the public prosecutor’s office could have dismissed the complaint if they had regarded the allegations as completely irrelevant. Nevertheless, the presumption of innocence applies.
The lawsuit is about the stock deal between Alpstaeg and Walter Stierli. On February 26, 2019, the Board of Directors determined that Bernhard Alpstaeg owned a 25 percent stake in Stierli’s shares. However, the current board of directors is certain that not everything was legal back then. “Presumably criminally relevant facts have led to this approval being given,” said board member Ursula Engelberger-Koller the day after the general meeting in December. For this reason, Alpstaeg was summarily deprived of 25 percent of its shares.
Alpstaeg was informed about the ad
The FCL leadership and Bieri do not want to comment on the opened procedure on Blick request. Unlike Alpstaeg, who has only been registered with 27 percent in the share register for almost a month. If the 77-year-old was still wondering a week ago where the criminal complaint was, he has now received it. “The public prosecutor’s office has confirmed that the ad exists. But we haven’t seen them yet,” says his spokesman Sacha Wigdorovits. In the next few days they will request access to the files in order to be prepared for a possible interrogation.
It is unclear how long the prosecutor’s investigation will take. However, it must be assumed that this will take several weeks. According to Engelberger-Koller, the criminal complaint is 37 A4 pages long. The responsible lawyer must now interpret, analyze and evaluate this. That takes time.
Three conceivable scenarios
The outcome of the investigation is also unclear. There are basically three possible scenarios: The first plays into Alpstaeg’s cards. In this case, the prosecutor would come to the conclusion that there was no criminally relevant behavior on his part and the investigation would be closed for this reason.
The situation is different if the public prosecutor considers what is described in the advertisement to be relevant under criminal law. Then he could issue a penalty order or even take the case to court. This third conceivable scenario would only delay the shareholder dispute even further. The FCL drama would then be decided in a court case.
